TO:

All Concerned Shipping Companies/Operators and Other Maritime Entities Concerned

 

SUBJECT:

Implementation and Enforcement of the Exclusion and Safety Zones Established under Proclamation No. 72

 

This is to enjoin compliance with the provisions, as they concern the operation of vessels, of Proclamation No. 72, entitled “Establishing Zones for Offshore Natural Gas Wells, Flowlines, Platforms Pipelines, Loading Buoy and Other Related Facilities for the Malampaya Deep Water Gas-To-Power Project Over Certain Waters and Submerged Lands Adjacent to Batangas, Mindoro and Palawan”, and its Rules and Operating Guidelines, as follows:

 

(1)      Entry of vessels, sub-sea activities and all other activities involving use of vessels which may pose potential risks to the Malampaya Deep Water Gas-To-Power Project, are prohibited in the Exclusion Zone, as described and bounded in above-cited issuance, without the prior authorization from the Maritime Industry Authority, Department of Energy, the Department of National Defense, and the Service Contractor.

 

(2)      Anchoring, fishing, and all other activities involving use of vessels which may pose potential risks to the Project infrastructure and to public safety within the Safety Zone, as described and bounded in the above-cited issuance, are likewise prohibited without the prior authorization from the aforecited government and private offices.

 

Non-compliance with the foregoing provisions shall be subject to sanctions prescribed under the Public Service Act, as amended, the Philippine Merchant Marine Rules and Regulations and pertinent MARINA Memorandum Circulars.
